Please take time to read through our Terms & Conditions of the Agreement, concerning the provision of a passenger transfer service ("Service") between You and Swale Airport Transfers.
Swale Airport Transfers means " We ", " Us " , " Our ", " Driver "; "You" and "Your" means any individual, company or other business that places the booking with us by either phone, text, e-mail or in person.
2.1. Swale Airport Transfers at your request, will provide You with a quotation, based upon the information supplied by You, during the enquiry process.
2.2. You are responsible to check Your booking confirmation carefully and inform us promptly of any errors.
2.3. You must allocate sufficient time, when booking Your transport, to allow for the check-in times required by Your airline, ferry or train company and for any delays caused by traffic conditions or other circumstances, beyond Our control.
2.4. Swale Airport Transfers shall not be responsible for any delays caused by Your failure to allow enough time to reach Your destination or by Your party, for not being ready for collection as scheduled in Your booking.
2.5. If You instruct Swale Airport Transfers to decide on the best pick-up time for You or Your party to reach Your destination on time, We shall do so to the best of Our knowledge but shall not be held responsible for any delays in Your journey, caused by unforeseen circumstances ( Eg: ill passengers, road-rage, road works, accidents, traffic jams, breakdowns, etc.).
2.6. You must order a suitable car size, appropriate for the number of passengers and volume of luggage that is intended to be conveyed.
2.7. Swale Airport Transfers cannot guarantee to carry excessive amounts of luggage.
2.8. By law, a child, no matter what age, counts as one passenger.
2.9. If passengers require special arrangements, ( eg. wheelchair access, etc.), it must be clearly stated at the time of making the enquiry, as we cannot guarantee the carriage of luggage if not informed.
2.10. All bookings by E-mail/text, MUST NOT be considered as "booked", unless You have received confirmation from Us. We will do so, within 48 hours of receiving your request, by return E-mail/text and by calling You, on the contact number You have given Us, at the time of placing Your booking.
2.11. Should you not receive a confirmation message within this time limit, or should you have an urgent query, then please do call our booking lines on either 07970 021 993 or 01795 870 853.
2.12. For all E-mail booking communications, please ensure You add firstname.lastname@example.org, to Your E-mail safe contact list ( We would also advise You to check Your SPAM folder, if Our e-mail doesn't get delivered to You ).
2.13. Eating and drinking in our vehicles is not permitted. Smoking is strictly prohibited by Law.
2.14. Swale Airport Transfers will not carry more passengers than its insurance or licensing allows it.
2.15. If You are experiencing delays going through Customs, You must inform Us within ( 45 ) minutes of Your airline/ferry or rail company's advertised arrival, on their " Live Arrivals " webpage.
3. Prices, payments & charges (£)
3.1. Unless otherwise stated, all prices are exclusive of VAT, which if applicable, will be charged in addition.
3.2. Swale Airport Transfers may amend the initial agreed quote given, if there is any material change to the original itinerary, the number of passengers, or the type or size of vehicle required
3.3. Swale Airport Transfers will notify and seek Your approval of the new quote ( see paragraph 3.2. ), prior to making any charges to Your account ( while awaiting approval, the delivery of service will be placed on hold ).
3.4. All Our pre-agreed fares, unless otherwise stated, are based on one (1) pick-up and one (1) drop-off; for additional pick-ups/drop-offs, customers are advised to request a quote, and provide an e-mail /mobile telephone number, where the agreed quote is to be sent, prior to their journey taking place.
3.5. Failure to agree on a fixed fare for multiple pick-ups/drop-offs at the time of booking, would attract additional charges, where a taximeter is to be used as a fare calculator, between the non-agreed pick-up/drop-off points. This charge will be in addition to your initial agreed fare.
3.6. The quote will include a ( 45 ) minutes waiting period, after the airline/ferry or train company's advertised arrival, on their website's " Live Arrivals" web page, unless otherwise agreed.
3.7. Swale Airport Transfers will charge for waiting time at its standard rates, after the initial ( 45 ) minute period has expired ( currently £20/hour or part of an hour ).
3.8. In the event of a flight/ferry or train delay, of which You have made Us aware of or, of which We are aware of, We will reschedule Your transfer at no extra cost to You, subject to Our availability.
3.9. If We cannot make contact with You within the allocated ( 45 ) minutes waiting time, and after We have had received the arrival confirmation of Your flight/ferry or train from the airline/ferry or rail company's "Live Arrivals" web page, We will allow an extra ( 30 ) minutes waiting time ((at a cost to You (£20)), at the end of which the Driver will be called back to base and no refund will be made on Your pre-paid journey.
3.10. If We do make contact with You, after the Driver was called back to base and, at Your request, We will send out the next available Driver, but We shall be under NO obligation to do so, and You will be responsible for payment of an additional one-way journey plus waiting time charges ( see paragraph 3.9. )
3.11. A " Meet & Greet" service is available upon request, subject to payment of an additional £10 plus parking charges.
3.12. You will be charged £50 to cover cleaning costs in the unlikely event of the vehicle being soiled by any member of Your party.
3.13. Payment can be made by MasterCard/Visa credit/debit cards or Cash
3.14. All journeys originating from must be pre-paid before the date of travel ( one-way & two-way journeys ).
4. Cancellations/Refunds & Termination of service
4.1 If You need to cancel Your booking, please contact us as soon as possible, by phone only.
4.2 Cancellations made more than 48 hours prior to the date of travel, will be refunded as follows:
a). Where payment was made by cash, a refund of 90% of the total fee paid will be made
b). Where payment was made by card, a refund of 85% of the total fee paid will be made
4.3 Cancellations made less than [24 hours] prior to the date of travel, will be refunded as follows:
a). Where payment was made by cash, a refund of 75% of the total fee paid will be made
b). Where payment was made by card, a refund of 70% of the total fee paid will be made
4.4. Swale Airport Transfers will refuse or terminate any booking, with immediate effect, if it places Our Driver or vehicle at risk of damage, violence or abuse by You or by any passenger in Your party and will ask all passengers to vacate the vehicle as soon as it is safe to do so.
4.5. No refunds will be given if the journey is terminated part way through the hire.
4.6. Swale Airport Transfers shall be entitled to cancel all services and provide refunds in the event of a declared national emergency, riot, war, fuel shortage, extreme weather or terrorist attack, or other circumstances beyond its control.
5.1. Swale Airport Transfers shall use all reasonable endeavours to get You to Your destination on time, but shall not be liable for any loss due to delays caused by road traffic or other conditions or events beyond its control.
5.2. Under no circumstances shall Swale Airport Transfers) be liable (in contract, tort or otherwise) for any loss of profits, business or for any indirect or consequential loss whatever. ( 5.1. )
5.3. Swale Airport Transfers shall not be responsible for any delays caused or costs arising from, by Your personal or flight/ferry or rail company's failure to provide Swale Airport Transfers with the correct information.
5.4. Swale Airport Transfers will endeavour to check for flight /ferry or train delays before the driver is sent out, but shall be under no obligation to do so.
5.5. All luggage is carried entirely at Your own risk ( including any child seats left in Our custody ).
5.6. If the vehicle breaks down during Your journey, Swale Airport Transfers will endeavour to arrange an alternative vehicle to complete the journey as soon as it is practicable. However, You accept NOT to hold liable, Swale Airport Transfers, for missing Your flight, ferry, train or running late for Your appointment.
5.7. You shall indemnify Swale Airport Transfers against all losses, costs, damages and expenses arising from any act or omission of any passenger in Your party.
5.8. You shall be responsible for the behaviour of all the passengers in Your party, during the journey.
5.9. Neither party excludes or limits its liability for death or personal injury caused by negligence, or for wilful default or fraudulent mis-representation or otherwise in any manner unenforceable by any applicable law.
6.1. Swale Airport Transfers may subcontract its obligations under this Agreement. You shall not assign, transfer or delegate any of Your rights or obligations under this Agreement.
6.2. Swale Airport Transfers may change these Terms & Conditions at any time by posting changes online, without prior notice. Please review these Terms & Conditions regularly, to ensure that You are aware of any changes.
6.3. All existing bookings will be at the rate quoted or applicable rate in effect at the time of booking.
6.4. Swale Airport Transfers shall store, process and use all information regarding Your personal details in accordance with the requirements of the Data Protection Act 1998.
6.5. This Agreement and any accompanying quotation represents the entire agreement between You Swale Airport Transfers, in relation to its subject matter. If there is any discrepancy between the Terms of this Agreement and the quotation, the Terms of this Agreement shall prevail.
6.6. Nothing in this Agreement is intended to confer any benefit on any third party, whether pursuant to the Contracts ( Rights of Third Parties ) Act 1999 or otherwise, and no third party shall have the right to enforce any rights under this Agreement except where otherwise agreed in writing.
7.1. This Agreement shall be construed in accordance with English Law and You and Swale Airport Transfers, each agree to submit to the exclusive jurisdiction of the English Courts in respect of any dispute or claim arising out of or in connection with this Agreement.
8. Conveying of children
8.1. UK law states that taxis are exempt from legislation relating to children travelling in a baby/child or booster seat.
8.2. If You are booking a return journey and have Your own child seat, by prior arrangement, the Driver who carries out Your booking may retain Your child seat for the return journey, but, the installation of the child seat must be carried out by You .
8.3. Suitable child seats should, wherever possible, be supplied and fitted by the child’s parents.
